Rally Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Rally mobile application and related services (the "Service"). By creating an account or using Rally, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Rally is a platform for discovering, creating, and joining local sport meetups ("rallies"). We provide software tools (profiles, maps, join/check-in flows, notifications, and moderation tools). Rally is not a sports club, event promoter, insurer, or employer of organizers or participants, and we do not supervise in-person activities.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) and capable of forming a binding contract. You are responsible for the accuracy of information you provide and for keeping your login methods secure.

4. Accounts

You may sign in with Apple, Google, or email magic link. You must not impersonate others, create accounts for abusive purposes, or share access in a way that violates these Terms. We may suspend or terminate accounts that breach these Terms or create safety risks.

5. Real-world meetups & assumption of risk

Rallies occur in the physical world and involve inherent risks (injury, property damage, weather, traffic, interactions with strangers, and other hazards of sport and public spaces).

You participate voluntarily and at your own risk. You are solely responsible for your preparation, equipment, fitness, route choices, and personal safety. Rally does not conduct background checks, verify medical fitness, or guarantee the identity, skill, or conduct of any user.

Organizers are responsible for setting accurate details (time, place, sport, difficulty) and for canceling or updating rallies when plans change. Participants are responsible for deciding whether a rally is appropriate for them.

6. User content & license

You retain ownership of content you submit (e.g. rally titles, descriptions, profile text, photos). You grant Rally a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content as needed to operate and improve the Service.

You represent that you have the rights to the content you upload and that it does not infringe others’ rights or violate law.

7. Acceptable use

You agree not to:

• Harass, threaten, stalk, discriminate against, or harm others
• Post false, misleading, or spam rallies; or use Rally for commercial solicitation without our prior written permission
• Share illegal content or use Rally for illegal activity
• Circumvent check-in, blocking, reporting, or other safety features
• Scrape, reverse engineer, or overload the Service except as allowed by law
• Upload malware or attempt unauthorized access to accounts or systems

We may remove content, cancel rallies, limit features, or suspend accounts to enforce these rules or protect users.

8. Safety tools

Use in-app Report and Block tools if you encounter abusive or unsafe behavior. Check-in is a proximity helper for organizers and participants; it is not a guarantee of safety or identity verification.

If you are in immediate danger, contact local emergency services (in Romania: 112). Do not rely on Rally support for emergency response.

9. Notifications

If you enable push notifications, we may send reminders and updates about rallies you organize or join, and other service messages according to your preferences. You can change notification settings in the app and in your device settings.

10. Intellectual property

The Rally name, branding, app design, and software are owned by Rally or its licensors. Except for your user content and rights granted by law, these Terms do not give you ownership of Rally IP. You may not copy or reuse our branding without permission.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that rally details or user profiles are accurate or complete.

12. Limitation of liability

To the maximum extent permitted by applicable law, Rally and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury, property damage, or losses arising from in-person meetups, user conduct, or reliance on rally information.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence where such limitation is prohibited).

13. Indemnity

You agree to defend and indemnify Rally against claims arising from your misuse of the Service, your rallies, your content, or your violation of these Terms or others’ rights, to the extent permitted by law.

14. Termination

You may stop using Rally and delete your account in Settings. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

15. Changes to the Service or Terms

We may modify the Service and these Terms. We will update the “Last updated” date and may notify you in-app or by email for material changes. Continued use after changes become effective constitutes acceptance, except where additional consent is required.

16. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. Courts in Romania shall have jurisdiction, subject to mandatory consumer venue rights.
